5. Scope of activity and nature of the service
ClearOffert is a software platform for the structured audit of third-party offers. The platform translates incoming offers into a comparable form and provides the user with a structured preparation for their own decision-making.
Important clarification of the provider’s role: SysTec Analytics Ltd operates the audit platform. It is not a party to contracts concluded between the property manager and the respective offeror and does not provide craft, construction or comparable services. The platform’s evaluation is a structured preparation of data supplied by the user and replaces neither a professional nor a legal review in the individual case.
No legal advice: The platform does not give a legal assessment of contractual clauses and does not replace advice from a lawyer. It makes no statements on the legal validity of agreements.
6. Responsibility for content and links
The company is responsible for its own platform content under the general laws. It is not obliged to monitor third-party information posted or transmitted by users. Obligations to remove or block the use of information under the general laws remain unaffected. Where the platform contains references to external third-party websites, no warranty is assumed for their content.
7. Copyright and protective rights
The ClearOffert platform, its software, content and design are subject to copyright and other protective rights. Trade mark, name and sign rights in the designation ClearOffert belong to SysTec Analytics Ltd.
8. Consumer dispute resolution
The platform is aimed at business clients. SysTec Analytics Ltd is neither obliged nor, as a rule, willing to participate in dispute resolution proceedings before a consumer arbitration body. Mandatory statutory obligations to the contrary remain unaffected.
9. Applicable law
The legal relationship between the company and users of the platform is governed by the law of England and Wales. Mandatory consumer-protection provisions of the state in which a user acting as a consumer has their habitual residence remain unaffected.
